Costa Rican officials are still investigating the tragic death of 14-year-old Miller Gardner, the son of former Yankees player Brett Gardner.

Miller passed away on March 21 at the Arenas del Mar Beachfront and Rainforest Resort, and the inquiry is looking into whether foul play could be involved.

“The aim of our investigation is to assess the potential for murder,” a spokesperson for the prosecutor’s office stated, while speaking to ESPN on Thursday. “At this point, we cannot definitively say whether a crime has occurred.”

According to a toxicology report released in early April, Miller died from carbon monoxide inhalation. The report indicated dangerously high levels of carbon monoxide in hotel rooms adjoining the machine room.

The resort has contested the findings, claiming that the elevated levels of carbon monoxide are confined to the machinery area and do not extend to the hotel rooms.

It seems authorities are in the early stages of a criminal investigation, collecting and assessing evidence. A subsequent phase may involve formal charges ahead of a trial.

Initially, there were theories that he might have choked while sleeping due to food poisoning, but it was later clarified that his airway was not blocked.

The Gardners have not provided any further statements following the obituary for Miller published on March 31.

“His passing will resonate deeply with friends, teammates, teachers, and coaches for years to come,” the family reflected.

“Though his time was brief, his spirit will endure through those he touched. Miller experienced the joy of friendship in his 14 years and wished for other children to have the chance to create beautiful memories,” they wrote.

Brett Gardner, now 41, completed his 14-season career with the Yankees in 2021. He was a part of the 2009 World Series championship team and enjoyed a successful career marked by All-Star selections and Gold Glove awards, all while representing the Bronx.
