Federal Judge Orders Release of Anti-Israel Activist on Bail

A federal judge has decided to grant bail to Mahmoud Khalil, an activist critical of Israel, allowing him to await the outcome of his immigration and civil cases in a more comfortable setting. This ruling came on Friday from Judge Michael Fabiartz, who, during a New Jersey court hearing, described Khalil’s detention as “very rare” and indicated that he didn’t pose a flight risk or threat to the community.

Khalil’s legal team argued in a letter that keeping him in the Immigration Detention Center in Jena, Louisiana, was an unusual move by the government, representing what they claim is unconstitutional retaliation against him.

Khalil, who is a legal permanent resident, was taken into custody outside his Columbia University apartment back in March. He quickly filed a habeas corpus lawsuit to challenge his detention and requested either bail or transfer to immigration facilities located in New Jersey.

The situation surrounding Khalil has sparked significant debate among anti-Israel activists and advocates for immigration rights. Critics suggest that the Trump administration’s actions reflect a hostility toward those expressing dissent against Israeli policies, particularly concerning the ongoing conflicts in Gaza and Iran. The government maintains, however, that Khalil has breached immigration laws through alleged ties to terrorist organizations.

Meanwhile, a DOJ attorney has contended in court that the federal court lacks the jurisdiction to release Khalil due to another pending claim regarding his green card status. The attorney stated that Khalil is currently being held on accusations of having intentionally misrepresented facts about his immigration application.

As this story develops, further updates are likely.
