Kilmer Abrego Garcia, a Salvadoran immigrant erroneously deported by the Trump administration, has faced severe mistreatment in a Salvadoran prison, according to a recent court filing. This information comes just days before a significant hearing in Greenbelt, Maryland, where his legal status will be closely examined.

In documents submitted to District Judge Paula Sinis, Abrego Garcia’s attorneys detailed numerous abuses suffered in Cecot, a notorious anti-terrorism facility in El Salvador. Allegations include psychological torture, sleep deprivation, and extreme exposure to humiliating treatment upon arrival in March.

Abrego Garcia and others reportedly encountered guards who ominously welcomed them, saying, “Welcome to Cecot. Those who enter here will not leave.” According to the filings, he soon found himself collapsed in a cell and subjected to harsh living conditions, including sleeping on metal mattresses and restricted access to food and water. Detainees were made to kneel for extended periods, forcing them to endure significant fatigue.

Sadly, his health declined rapidly—his attorney mentioned a loss of about 31 pounds within just two weeks. Reports of psychological torment included threats of violence and being told he might be moved to areas housing known gang members.

Abrego Garcia observed violent incidents among prisoners nearby, where screams echoed throughout the night with no response from guards. This public record mirrors accusations from the administration claiming he was affiliated with the MS-13 gang.

The deplorable conditions at CECOT are just one element Judge Sinis will address in the upcoming hearing, where she’ll consider allegations made by both Abrego Garcia’s legal team and the Trump administration, particularly regarding the status of his case and potential sanctions against government officials for their dismissive actions.

His lawyers argued against the classification of the case as merely a disagreement given that Judge Sinis can still mandate his return to Maryland. They have requested he be brought back from Tennessee, where he was sent to face criminal charges. They also noted concerns from the Trump administration about the possibility of removing him from the U.S. without prior notice.

Complicating matters is a simultaneous ongoing criminal case in Tennessee. A federal judge ordered the Trump administration to adhere to guidelines that restrict officials from making public statements regarding Abrego Garcia.

In legal documents, his attorney criticized the administration for making repeated inflammatory comments that could jeopardize his right to a fair trial, labeling him unfairly as a gang member and criminal. A magistrate judge overseeing his criminal case pointed out insufficient evidence presented at the time of his June arrest.

The future of Abrego Garcia’s case remains uncertain, reflecting the complicated interaction of civil and criminal proceedings. Judge Sinis has previously conveyed her frustration with the slow pace of the Trump administration in fulfilling court requests for information.

The next court appearance is set for 11 a.m. on Monday.
