Investigation Into Marine’s Death Raises Questions

A tragic case involving a young Marine, Noah Presgrove, who was found dead on the roadside in Oklahoma, is now the subject of a civil lawsuit filed on June 23, 2023. Presgrove, 19, had attended a Labor Day party with friends just before his body was discovered on September 4, 2023, along US Highway 81 in Terral.

Initially, authorities thought that Presgrove may have been struck by a vehicle after the party. However, the lawsuit contends that his death was not related to a car accident, seeking at least $75,000 in damages.

According to the lawsuit, local attorney Andrew Benedict, representing the defendants Johnny Trout Wilcoxon Jr. and Stevie Howard, has not commented on the matter. Some defendants do not have legal representation, and there has been no response from them as of yet.

The lawsuit claims that Jack Newton, under 21, purchased alcohol from a nearby convenience store, and at the time of his death, Presgrove’s blood alcohol content was reported to be nearly double the legal limit. It appears he was drinking during a house party before going for a ride on an ATV.

According to investigations, the area where Presgrove was found was unlit and lacked any signs of a vehicular incident. Witnesses indicated that he was involved in a rollover ATV incident but had returned to the party afterward. He was reportedly last seen engaging in a conversation with Howard and Newton around 3:41 AM on September 4.

Medical examiners determined that the cause of death was blunt force trauma to the head, torso, and limbs. The lawsuit asserts that Presgrove was assaulted by one or more defendants but does not conclusively state that this led to his death.

Allegations in the lawsuit include negligence, recklessness, and violations of care by the accused parties in connection with Presgrove’s death. This young man, who had vivid plans to graduate from high school and join the military with his cousin, tragically met an untimely end.
