‘A Clear Violation Of Her Order’: Sol Wisenberg Reacts To Jack Smith’s Latest Legal Moves

Former Deputy Independent Counsel Sol Wisenberg said Thursday that Special Counsel Jack Smith's latest legal action was a “clear violation” of the judge's orders.

Lawyers for former President Donald Trump filed a lawsuit against District of Columbia District Judge Tanya Chutkan, accusing Smith of violating Chutkan's Dec. 13 suspension order, one of which is pending appeal. They asked that Mr. Smith be held in contempt of court. On December 7, Mr. Chutkan rejected a motion by Mr. Trump's lawyers to dismiss the four-count indictment secured by Mr. Smith in August, citing presidential immunity. “Well, let's first talk about whether he violated the court order, her order, her stay order. And I think he clearly violated it at the time he filed the lawsuit,” Weisenberg said. told “The Ingraham Angle” guest host Jeanine Pirro. “Her order basically says we are not going to impose new discovery obligations on any of the litigants, and he filed a motion on a limited basis. I have to comply. So I think this is a clear violation of her orders.”

The Supreme Court declined to hear Mr. Smith's request to directly consider his appeal of the Chutkan decision against President Trump's efforts to have the charges dismissed. Mr. Chutkan previously refused to withdraw from the case in a September 27 ruling, and on October 16 he imposed a gag order on Mr. Trump.

“I don't think she meant to disrespect Jack Smith,” Weisenberg continued. “She did her best and did everything in her power to grant the government's motion in this case. So I don't think that's going to happen. The most she would do is say that the motion should be withdrawn now. I think that’s about it.”
