Abbott approves Texas law restricting restroom use for transgender individuals

Texas Governor Signs Controversial Bathroom Bill

On Monday, Texas Governor Greg Abbott signed a new bill mandating that residents utilize bathrooms in certain public facilities based on their sex assigned at birth.

This legislation, which passed through the Texas House with a vote of 86-45, will take effect on August 28th. It applies to government-owned buildings, specifically targeting public schools and universities. This encompasses restrooms, locker rooms, changing facilities, and shower areas, all defined as “prolific private spaces.”

Additionally, the bill instructs the Texas Department of Criminal Justice to ensure that inmates are housed in correctional facilities according to their designated gender.

Under this law, Texas domestic violence shelters cannot provide services to transgender women unless they fall under the age of 17 and are children of women currently receiving assistance.

Before the bill’s final passage, an amendment was introduced that mandates the imposition of fines on Republican representatives for violations: $25,000 for the first offense and $125,000 for further breaches. Initially, the fines were set at $5,000 and $25,000, respectively.

This amendment received approval with a vote of 84-41.

There are exceptions in the law for specific situations, such as maintenance work, law enforcement actions, or when a caregiver is accompanying a child under nine years old into these spaces.

In a post on the social media platform X, Abbott referred to the law as “a common sense public safety issue.” The bill is scheduled to come into force on December 4th.

The American Civil Liberties Union (ACLU) of Texas criticized the bill upon its passage, describing it as “merciless and unconstitutional.” They emphasized that Texans, including members of the transgender community, deserve access to public facilities that align with their gender identity in a safe, respectful environment.

Currently, seven states, including Texas, enforce prohibitions on transgender individuals using bathrooms corresponding to their gender identity in all government-owned buildings. Additionally, thirteen other states have similar restrictions in place for some public facilities.
