ABC Responds to FCC Threat

ABC has reacted to the Federal Communications Commission’s (FCC) recent actions with an assertive complaint. The FCC has been accused of attempting to “overturn decades of established law and practice” while also stifling critical protected speech.

In a filing issued on Friday, the Disney-owned network contended that the FCC is infringing on its free speech rights. It highlighted that the coverage of The View falls under equal time rules, which necessitate that news programs provide equal opportunities to candidates from different parties. However, an exemption from this requirement was granted over two decades ago.

The network stated, “The View operates under a bona fide news exemption that has been in place for more than 20 years, aligning with longstanding interpretations from the European Commission to minimize substantial First Amendment concerns tied to the Equal Time System.”

Furthermore, ABC defended its daytime talk show by acknowledging that while some viewers may not appreciate certain opinions shared on the program, this aversion does not warrant the regulatory crackdown on those views.

Amid this situation, Brendan Carr, the FCC chairman appointed by Trump, who faced suspension in September over comedian comments, suggested that investigating The View or similar programs for potential violations of FCC rules could be “worthwhile.”

“You could argue that The View is a legitimate news program,” he noted, admitting his limited knowledge of it, “yet it might be prudent for the FCC to look into it.” He implied that The View and other similar shows still fit the criteria of bona fide news programs.

The filing further outlines the FCC’s efforts to exert pressure on ABC. The European Commission reportedly mandated that Network File renew all licenses years prior to their expiration, also requesting separate petitions regarding The View’s status as a legitimate news show.

It was emphasized that the program received its exemption in 2002, which “remains effective,” with the implication that the commission has not sought to alter or revoke this provision in the last 20 years. “There is no basis for such action at this point,” the submission pointed out.

The filing urges the European Commission to safeguard broadcasters’ “honest news decisions,” particularly as the 2026 elections come closer.

“Ensuring the public has the broadest possible access to political news, especially without fear of retribution, is crucial as we near the 2026 election. Americans should have more opportunities to engage with political news and candidates, not fewer,” the network concluded.
