ABC Files Lawsuit Against Trump Television Regulator for Broadcast License Threats

ABC, which is owned by Disney, has initiated a First Amendment lawsuit against the Federal Communications Commission (FCC), claiming that the agency’s recent actions are part of what they describe as a “retaliatory campaign.”

The lawsuit, brought to federal court in Washington, D.C., suggests that the Trump administration’s efforts against ABC have become more aggressive during the current administration’s second term. This legal action follows an FCC directive issued in April that instructed eight Disney-owned TV stations to begin the process of renewing their broadcast licenses sooner than usual, according to news reports.

ABC’s lawsuit contends that the issue emerged prominently when a new commission chairman was appointed, who vowed to pursue the administration’s agenda vigorously. The situation escalated when the commission required stations to seek license renewals earlier than expected, something that the lawsuit argues is a form of retaliation.

In its legal filing, ABC claims the administration’s actions against its broadcast license are neither new nor unexpected. They point out that President Trump has a history of criticizing ABC’s news coverage and has suggested revoking the network’s broadcast license as a means of reprisal for its reporting.

ABC argues that the timing of the FCC’s review requests is unusually swift, with most stations facing scrutiny well before the legal timeline allows for renewal. The network asserts that this early inquiry highlights the FCC’s intent to exert pressure on networks that do not align with the administration’s expectations.

Meanwhile, an FCC representative responded to these claims, asserting that all broadcast stations—including Disney—have an obligation to serve the public interest. They noted that the FCC has been investigating allegations of unlawful discrimination linked to Disney for over a year. The representative suggested that Disney’s lawsuit appears to be an attempt to misinform the public and to disrupt the ongoing investigation.

In previous statements, President Trump expressed a desire to revoke licenses for certain networks, including ABC and NBC, for their decision not to air his speeches on election security. He characterized their actions as a significant failure, arguing that such a breach warranted license revocation.

FCC Chairman Brendan Carr, while addressing the situation, clarified that he does not see the commission as a “speech police.” He had previously announced on social media that an investigation into Disney and ABC had commenced based on concerns about their diversity, equity, and inclusion practices, which he believes may violate FCC standards against certain discriminatory practices.
