Kilmer Abrego Garcia, a Salvadoran immigrant wrongly deported back to El Salvador during the Trump administration, has reportedly experienced severe abuse, including physical and psychological torture, while held in custody, according to a recent court filing. This disclosure comes as a significant hearing is set to take place in Greenbelt, Maryland.

These status hearings are crucial for closely tracking Garcia’s ongoing legal battle over his immigration status in the United States. His attorneys have detailed a troubling account of conditions at CECOT, a notorious anti-terrorism prison in El Salvador, where Garcia was allegedly subjected to intense mistreatment from the moment he arrived in March. Guards reportedly welcomed detainees with statements like, “Welcome to Cecot. Those who enter here will not leave.”

In the court documents, it was noted that Garcia soon collapsed in his cell and faced severe deprivation, including limited food and sleep. Inmates were forced to kneel for long periods and were subjected to degrading treatment. Garcia’s health deteriorated rapidly, with reports indicating he lost approximately 31 pounds within just two weeks of his detention.

Compounding these conditions, Garcia was allegedly threatened with violence, including being informed that he could be moved to cells housing dangerous gang members. The situation within the prison was dire, with inmates often bleeding or screaming from other cells, creating an atmosphere of constant fear and dread. This, of course, adds weight to claims by officials that Garcia is linked to the MS-13 gang.

Upcoming hearings are expected to delve deeper into these allegations, as the presiding judge, Paula Sinis, examines claims from both the Trump administration and Garcia’s legal team. Garcia’s attorneys argue that his case shouldn’t be dismissed as a simple dispute, asserting there is sufficient basis for him to return to the U.S. from Tennessee, where he is currently being held due to criminal charges. They also highlighted threats regarding his potential removal to third countries known for human rights abuses.

The complexity of this case is intensified by ongoing criminal proceedings in Tennessee. A federal judge recently mandated that the Trump administration must adhere to restrictions preventing public commentary about Garcia from Justice Department and DHS officials.

Garcia’s legal representatives expressed concern over inflammatory comments made by the administration, which they believe could jeopardize his right to a fair trial. They criticized the lack of credible evidence against him and pointed out that accusations of gang affiliation have not been substantiated.
