AG Orders Review After NH Parents Barred from Protesting Trans Athletes

Attorney General Pam Bondy ordered the Department of Justice (DOJ) to consider cases where New Hampshire parents are being prevented from protesting transgender athletes.

Bondi announced on X on Wednesday that she had asked DOJ’s Civil Rights Division to “examine” the case.

In September, several parents wore pink wristbands. “XX” was playing for other teams as a sign of protest during a high school soccer game identifying Parker Tirell, a male athlete now 16 years old.

Local media reports say Bow and Dumbarton school district chief Mercy Kelly responded to wristbands by issuing trespass notices to parents, including Antony and Nicole Foot, Kyle Feller and Eldon Rush. Orders without Trading Pass have ended.

The parents then sued the school district, alleging that their First Amendment rights had been violated and asked the judge to wear wristbands featuring “xx” at school events while the case was underway.

US District Judge Stephen McAuliffe, appointee of President George HW Bush, said he ultimately sided with the school district and acted reasonably to prevent his parents from protesting.

“The plaintiffs may not have intended to convey any sleazy or harassment messages directed at Parker Tirell and other transgender students, but the symbols and posters they displayed were able to convey such a message in full,” he writes. “And that broader message is something that school authorities have reasonably understood and tried to prevent appropriately.”

“A message of broader and more despicable/harassment that the plaintiff’s ‘XX’ symbol for the district to convey was completely reasonable,” he continued.

A senior attorney at the Free Speech Institute, one of the lawyers representing his parents, said he disagreed with the court’s decision.

“This was an adult speech in a limited public forum. I enjoy First Amendment protections over student speeches in the classroom,” said Attorney Delcorde. I said In a statement. “Bow School District officials were clearly discriminatory based on perspective, as they perceived the XX wristband as “exclusive.” ”

The plaintiffs filed a notice following the ruling that the judge did not plan to enter more evidence before issuing a final decision.
