Legal Turmoil in New Jersey Over Attorney Expulsion

Well-known attorney Alan Dershowitz discussed a recent development in New Jersey during his podcast on Tuesday, describing the district judge’s decision to remove interim U.S. lawyer Alina Haba as indicative of something deeper.

On Monday, a panel of federal district judges—many appointed by Presidents Obama and Biden—dismissed Haba. This came following a request from Hakeem Jeffries, a Democrat from New York and House minority leader. Dershowitz pointed out that Haba has been replaced by someone who wasn’t selected by the president, as per the usual process.

“Alina Haba was appointed by President Trump. As I understand, she’s someone he knew well, and that’s quite standard practice for a president to appoint allies or associates,” Dershowitz noted. He referenced examples from past presidents like Ronald Reagan and John Kennedy who did similar things.

Dershowitz remarked that Haba’s interim appointment will not be extended since the judge opted for another individual who wasn’t chosen by the current president. He emphasized that the framers of the Constitution had specific limits on judges’ roles, noting that even Justice Ginsburg indicated the Constitution does not empower judges to act arbitrarily for justice.

Attorney General Pam Bondi quickly moved to remove Digily Lee Grace, the judge’s pick to succeed Haba. Despite admitting the existence of a law that allows judges to appoint U.S. lawyers in unique circumstances, Dershowitz argued that this law might be unconstitutional. He suggested that the Trump administration could have a solid case if they decided to challenge this ruling.

“There is a provision that gives judges unusual authority in appointing U.S. attorneys, but that really stretches beyond constitutional boundaries,” he asserted. “You can’t grant judges more authority than what the Constitution allows, and if it’s contested, it could lead to serious implications.”

In another incident, New Jersey Democrat Ramonica McQuiver faced backlash after allegedly confronting ICE agents, which apparently contributed to Haba’s dismissal from her position by Democrats.

Dershowitz concluded that the situation exemplified unconstitutional overreach by judges.
