Alec Baldwin attempted to have a manslaughter charge dismissed in a new motion filed Monday, according to documents obtained by Fox News Digital.
The Emmy Award-winning actor filed a fifth motion to have the charges dismissed, while his defense team continued arguments from an online hearing on Friday, in which one of “The Last” star’s two requests to end his manslaughter case was denied by Baldwin.
Judge Mary Marlowe Sommer declined to rule until at least Friday, June 28, on Baldwin’s request to have the charges dismissed due to the destruction of evidence.
Baldwin did not appear at the virtual hearing, but was spotted in the Hamptons over the weekend. The “30 Rock” actor had already filed paperwork with the court to waive all upcoming pretrial appearances.

Baldwin’s lawyers sought an order dismissing the indictment in a motion for expedited relief, arguing that the state violated its discovery obligations by failing to promptly disclose “material evidence” deemed favorable to Baldwin’s defense that would “fundamentally alter how Baldwin prepares for trial.”
“The State’s strategy – an ambush trial – is grossly unfair and anathema to the Court,” the document states. “The reasons are clear: Baldwin has had to devote significant time and resources simply to tracking the growing laundry list of unsealed evidence emerging from the cover-up, not to mention the time it would take to review the more than 150,000 pages of documents and countless hours of audio recordings and videotapes that were dumped on Baldwin just weeks before trial. Moreover, most of the State’s belated disclosure occurred after crucial motion and witness statement deadlines. This alone shows how Baldwin was seriously prejudiced by the State’s misconduct.”

His lawyers continued, “Baldwin deserves to be treated like any other criminal defendant. Both federal and state law point in the same direction: no charges will be filed.”

Judge Mary Marlowe Sommer denied Baldwin’s motion to dismiss during a hearing on Friday. Baldwin’s lawyers argued that prosecutors failed to prove the “Boss Baby” actor committed a crime. They noted it was “incomprehensible” that prosecutors acknowledged “the possibility of live ammunition” on the “Lust” set.
Sommer rejected the argument after a hearing that lasted several hours.
Hannah Gutierrez Reed was convicted of manslaughter in March after a jury found that the gun manufacturer behind “Lust” was responsible for the gun that fired live ammunition on the set of the Western, killing cinematographer Halina Hutchins. Earlier this month, Baldwin announced that his children would be starring in a reality TV show. TLC ProgramIt is scheduled to debut in 2025.
The show, tentatively titled “The Baldwins,” will feature the “ups and downs, the good, the bad and the wild and crazy” of family life with seven children under the age of 10, Baldwin said in a video shared on Instagram.
