Appeals Court Rejects Former Trump White House Official’s Request To Stay Out Of Jail During Appeal

A federal appeals court has rejected President Trump’s bid to keep former White House official Peter Navarro out of prison while he appeals his conviction.

Navarro, who is appealing his conviction for contempt of Congress for defying a committee subpoena on Jan. 6, will report to a Miami prison this week to begin his four-month sentence by March 19. I was ordered to do so. DC Circuit Court of Appeals agreed U.S. District Judge Amit Mehta earlier denied his request to suspend the prison sentence pending appeals.

“The appellant submits that his appeal presents serious questions of law or fact that are likely to result in a reversal, a new trial, a sentence that does not include a term of imprisonment, or a reduction of a term of imprisonment for less than the term. “[t]he order has not shown what has already been served, plus the anticipated length of the appeal process,” the order states.

Navarro, who served as former President Donald Trump’s trade adviser, was indicted in June 2022 for failing to provide documents requested by the committee on Jan. 6 and refusing to testify based on executive privilege. . The Department of Justice (DOJ) recommended that Navarro serve six months in prison and pay $200,000 after his conviction.

Mr. Navarro was ultimately sentenced to four months in prison and a $9,500 fine.

“[E]”Even if appellant had administrative privilege, it does not excuse his complete non-compliance with the subpoena,” the appeals court ruled Thursday. “Appellant did not claim, and could not claim, absolute immunity from testimony.”
