Apple Accuses OpenAI of Misappropriating Trade Secrets

In a significant legal development, Apple has accused OpenAI of instructing potential hires to bring confidential materials to job interviews as part of their effort to enhance their artificial intelligence initiatives for consumer devices. The allegations form part of a much larger trade secrets lawsuit filed against OpenAI and several former Apple executives in federal court, asserting that Apple’s confidential information was misappropriated to support OpenAI’s hardware projects.

“At Apple, we are consistently innovating and developing groundbreaking technologies, and safeguarding our intellectual property is a top priority,” stated an Apple representative. They further claimed that substantial evidence has emerged, indicating that OpenAI personnel have inappropriately taken proprietary information regarding Apple’s unreleased technologies and processes.

OpenAI has not yet responded to the request for comments regarding these serious allegations. According to Apple’s claims, OpenAI urged job candidates to prepare “deep dive” presentations on Apple projects and to bring specific hardware prototypes, including batteries and circuit boards, for a “show-and-tell” with interviewers. It is alleged that these requests were made to facilitate a deeper understanding of Apple’s technology during the interview process.

Apple has also pointed out that Tang Yew Tan, a former Apple VP who is now with OpenAI, used a codename for a confidential project when asking candidates about unreleased Apple products. One Apple employee reportedly remarked in surprise, “I didn’t know you could take them out of the office.”

The complaint suggests that this recruitment strategy was aimed at acquiring Apple’s trade secrets as OpenAI pushes to develop its consumer hardware. Apple highlighted that over 400 individuals previously employed by Apple now work for OpenAI, many of whom were directly involved in hardware development.

Furthermore, the lawsuit accuses former Apple engineer Chang Liu of improperly accessing Apple’s confidential systems after his departure, downloading sensitive files at OpenAI, and advising a colleague on how to bypass Apple’s security protocols prior to joining OpenAI. Apple argues that OpenAI has also utilized confidential information regarding Apple’s supplier relationships to advance its own hardware endeavors.

In light of these allegations, Apple is seeking the return of confidential materials and a court order to prevent further use of its trade secrets, as well as damages. The lawsuit represents a notable escalation in tensions between the two companies, who, despite these allegations, remain partners through the integration of ChatGPT into Apple’s offerings in artificial intelligence.
