Barring 18-20-Year-Olds from Concealed Carry Is Unconstitutional

U.S. District Judge William S. Stickman this week ruled against Pennsylvania’s ban on people ages 18 to 20 obtaining concealed carry permits for self-defense. was lowered.

Section 6109(b) of the Pennsylvania Concealed Carry Law states that anyone 21 years of age or older may apply for a carry license. Plaintiffs’ attorneys argue that Pennsylvania State Police Commissioner Robert Ewachick’s “aggressive enforcement” of Section 6109(b) regarding permit issuance will prevent law-abiding 18- to 20-year-olds from defending themselves. He pointed out that this means that it cannot be carried.

Lawyers argued, among other things, that Mr. Evachick’s execution violated the law-abiding Second Amendment rights of Mr. Lara and others who were over 18 and under 21.

Judge Stickman, an appointee of President Trump, reviewed Section 6109(b) in light of the U.S. Supreme Court’s decision. Heller (2008) and mcdonalds (2010) and made a decision that contradicted the concealed carry permit issuance guidelines. It also prohibited Evachick from arresting young people between the ages of 18 and 20 who openly carry a handgun in self-defense during a state of emergency, with an eye toward allowing firearms to be transported without fear of criminal prosecution. .

“Judge Stickman’s injunction gives 18- to 20-year-olds the same Second Amendment rights as anyone over 21,” SAF Executive Director Adam Kraut said in a statement regarding the lawsuit. Pennsylvania now allows young people between the ages of 18 and 20 to apply for a firearms license, barring enforcement of the state’s strict transportation laws.
