DOJ Report Claims Bias Against Pro-Life Activists Under Biden Administration

The Department of Justice, during President Trump’s administration, released a report early Tuesday suggesting that the Biden administration has actively targeted pro-life activists through FACE Act prosecutions, allegedly responding to requests from pro-abortion organizations.

This extensive report, spanning nearly 900 pages and examining around 700,000 internal records, argues that the Biden administration is misusing the Free Clinic Entry Act (FACE), favoring biased enforcement against pro-life individuals. The accusations include pushing for harsher sentences, employing aggressive arrest methods, and collaborating with pro-abortion groups for surveillance of pro-life activities, sometimes even making inappropriate remarks about religion.

Acting Deputy Attorney General Todd Blanche expressed condemnation over a potential two-tier justice system, asserting that the biased approaches of the Biden administration won’t persist as integrity is restored within the prosecutorial framework.

The FACE Act, established in 1994, aims to combat threats or violence against individuals seeking or providing reproductive health services while also protecting the freedom of religious expression. Curiously, it appears that since its inception, 97% of prosecutions under this law have targeted pro-life advocates.

The report highlights that the Biden administration focused heavily on prosecuting pro-life activists while neglecting to address violence against pro-life pregnancy resource centers, with only a handful of vandalism and assault charges filed.

Over Biden’s four-year term, there have been over 45 indictments of pro-life defendants in more than 20 cases related to FACE Act violations—marking an uptick compared to the previous administration. Additionally, some Christian pro-life activists faced multiple prosecutions.

Collaboration with Pro-Abortion Organizations

According to the report, the Department of Justice reinstated a task force under Attorney General Merrick Garland to combat violence against reproductive health providers. This task force is said to have collaborated with abortion organizations like the National Abortion Federation (NAF) and Planned Parenthood to monitor the activities of pro-life advocates.

There are allegations that these abortion organizations accessed inside information and used their connections to further their enforcement objectives concerning the FACE Act. The report states that these organizations not only shared concerns about potential violations but also tracked pro-life activist activities and provided this intelligence to the Biden Justice Department and the FBI.

It also emphasizes Sanjay Patel’s questionable conduct as the leader of the task force, alleging that he aligned the FACE Act with an archaic “conspiracy against rights” charge, thereby increasing potential penalties for pro-life advocates.

The report points to consistent communications between Patel and NAF’s security head, indicating that Patel viewed Davidson as instrumental in pushing for prosecutions.

Moreover, instances of pro-abortion groups compiling detailed information about pro-life activists were noted, showcasing a level of scrutiny that raises ethical concerns.

The report also mentions the inappropriate conduct exhibited by the Biden administration’s prosecutors, who showed bias against the religious beliefs of defendants. This bias allegedly manifested in attempts to exclude religious jurors and in the aggressive means used during arrests.

For example, in one case in Michigan, an Assistant U.S. Attorney expressed dissatisfaction about the presiding judge being “very Catholic.” There were also attempts to keep Christian jurors from serving and even to prevent defendants from displaying religious symbols during trials.

Notably, Mark Houk, a Christian father, was arrested in front of his family, an event that drew significant media attention. Despite initial resistance from local authorities, the FBI charged him under the FACE Act following a report from Planned Parenthood. Ultimately, he was acquitted and received a substantial settlement from the Justice Department.

Disparities in Legal Actions

The report underscores a notable disparity in sentencing practices under the Biden administration. It revealed that pro-life prosecutors sought much harsher sentences for defendants opposing abortion compared to those charged with violent acts related to pro-abortion sentiments.

Interestingly, the Biden administration has been criticized for not investigating attacks against pro-life pregnancy centers or churches, despite the potential applicability of the FACE Act in these instances. The report concludes by referencing the steps taken by Trump’s administration to rectify actions taken under Biden’s DOJ, including pardons for pro-life activists and dismissal of several civil lawsuits against them.

Overall, the report paints a picture of biased enforcement under the Biden administration, particularly concerning pro-life activists, raising significant ethical and judicial concerns.
