Exclusive: Biden’s Legal Decision on Deportation
A decision from the Biden administration may stop convicted murderers from being deported from the U.S., especially during ongoing legal disputes.
Fox News accompanied Immigration and Customs Enforcement (ICE) and Homeland Security investigations in Los Angeles, which has become a focal point for recent anti-ICE protests.
A source from the Department of Homeland Security mentioned that an individual cited the treaty against torture when he remarked, “I have a cat.” This person was given a DCAT—essentially a postponement of removal due to concerns about potential torture if returned to El Salvador.
A statement emphasized that this individual, a member of the notorious Threnos gang with a past of multiple serious convictions, “should never have been on the streets of Los Angeles.” The statement also noted that a curious legal ruling from December has permitted this individual to remain in the U.S., while officials expressed gratitude towards former President Trump’s administration for efforts to enhance public safety.
In recent developments, an appeals court declined the Department of Justice’s attempt to block Kilmer Abrego Garcia’s return from a prison in El Salvador.
This ruling has made it easier for Garcia to be released from ICE custody, although he was quickly detained due to concerns about public safety.
Guevara is still in federal custody, as authorities explore the possibility of sending him to another country, reflecting previous cases where the U.S. has relocated convicted criminals to places like South Sudan.
A federal judge in Boston recently ruled against removing third-party individuals, but the Department of Homeland Security is awaiting a Supreme Court decision that may change this outcome.
