U.S. District Judge Ana Reyes criticized Justice Department lawyers for failing to respond to a subpoena issued by the U.S. House of Representatives while Peter Navarro was in prison for similar conduct.
Navarro is serving a four-month prison sentence for failing to comply with a subpoena from the commission on January 6th. Navarro argued that for presidential aides to follow this rule would violate the Constitution’s separation of powers.
The Biden Justice Department relied on similar arguments in defending two lawyers, Mark Daley and Jack Morgan, from subpoenas by the House Judiciary Committee in President Joe Biden’s impeachment inquiry.

“There is a person in prison right now because you all filed a criminal case against him because he failed to appear on a subpoena from the House of Representatives,” Reyes said.
