Biden judge prevents Trump from deporting Palestinian activist Mahmoud Khalil based on Rubio's threat evaluation

Federal Judge Halts Deportation of Palestinian Activist

In a recent decision, a federal judge has temporarily barred the Trump administration from deporting Palestinian activist Mahmoud Khalil. The ruling marks a continuation of judicial opposition to Trump’s immigration policies.

Judge Michael Farbiarz issued a preliminary injunction on Wednesday, preventing the deportation while allowing the administration until Friday to appeal the ruling.

In a memo, Senator Marco Rubio suggested Khalil’s deportation due to his alleged anti-Semitic protests and activities that he claimed were detrimental.

Khalil originated from Syria and is married to a U.S. citizen. He was detained by ICE on March 8 in the lobby of his New York City apartment and has been held in custody in Louisiana since then.

Rubio argued that Khalil’s presence in the U.S. was a consequence of an unfavorable foreign policy. However, Judge Farbiarz challenged this threat assessment.

The judge did not rule on whether Khalil could be deported for allegedly withholding information about his green card application but noted that other legal residents in similar situations were rarely detained for such discrepancies.

Khalil’s legal team presented evidence suggesting that deportation could put him at risk of torture or death.

Some critics of the Trump administration have alleged that it violated Khalil’s freedom of speech rights. Conversely, his opponents cite connections between his group and more extreme rhetoric against the U.S. and Israel.

Supporters of the administration expressed frustration at the ongoing rulings by federal judges that oppose presidential policies and called for the administration to disregard these decisions. Meanwhile, Democrats cautioned that such actions could lead to a constitutional crisis.

Judge Farbiarz was appointed by President Joe Biden in 2023.
