Justice Department Officials Confused Over Mass Commutations

Senior officials at the Justice Department have been grappling with the implications of a large-scale pardon affecting thousands of prisoners just before the current administration took office.

Assistant Deputy Attorney General Brad Weinsheimer expressed his difficulty in understanding the commutations extended to approximately 2,500 federal inmates on January 17. He even requested a detailed list of these prisoners, specifically noting the crimes that were included in the commutation process.

According to Weinsheimer, the language included in the warrant from the Justice Department is quite ambiguous. He highlighted the need for clarification from the President regarding its interpretation, stating that resolving this issue is essential to align the language with its intended purpose.

“One more important note,” Weinsheimer added, referring to communications regarding the commutations. “The White House referenced individuals as having been convicted of non-violent drug crimes, which may not be accurate.”

He voiced concern about 19 “problematic” commutations that have already come to light. Some of these cases involve individuals convicted of violent offenses, which complicates the narrative of non-violent drug crime commutations.

“There could be even more concerning cases that haven’t been thoroughly examined yet,” Weinsheimer said. He lamented that, despite repeated requests, the department had not been granted adequate time to evaluate the cases in question.

“It’s worth noting that we didn’t receive relevant warrants or details until just moments before the list was made public,” he complained.

Investigations into the practices surrounding these automatic pardons have begun, with particular attention directed toward the potential misuse of presidential power by the Biden administration.

A spokesperson for Biden has not yet responded to inquiries related to these issues.
