A 13-year-old boy accused of fatally shooting a man whose feet were blocking the aisle on a Denver public bus has been charged as a juvenile with first-degree murder and other felonies, prosecutors announced Thursday. .

The Denver District Attorney’s Office is still considering whether to prosecute the boy as an adult, and the final decision will be up to a judge, said office spokesman Maro Kasparian.

His name has not been released because he is a juvenile.
Police said an investigation revealed the boy was engaged in a “verbal exchange” with a 60-year-old man on a bus in southwest Denver on Jan. 27 when he shot him. A second person also suffered minor injuries, police said.
The indictment against the boy, first reported by the Denver Post, includes two counts of first-degree murder, alleging he killed someone with extreme indifference to human life after deliberation.

The charges include felonies of assault and endangerment on public transportation and misdemeanor possession of a firearm as a juvenile.
