New York Mother Acquitted Due to Postpartum Psychosis

In a case reminiscent of the Lindsay Clancy trial that’s currently under consideration by a Massachusetts jury, a New York judge ruled that a mother suffering from postpartum psychosis is not criminally responsible for the deaths of her two children.

Dimone Fleming, 26, was found not guilty “by mental disease or defect” this week for the tragic deaths of her children, 3-year-old Daishawn Fleming and 11-month-old Octavius Canada, in a family shelter in the Bronx, as reported by a major news outlet.

This verdict has sparked similar controversies on social media, echoing the discussions surrounding the Clancy case, particularly regarding the defense based on postpartum mental health issues.

Part of the decision hinged on testimony from psychiatrist Dr. Eric Goldsmith, who was called by the prosecution. He indicated that Fleming was experiencing hallucinations, believing that the world was ending and that a spirit had taken over her body.

Goldsmith described Fleming as “grossly psychotic and out of touch with reality” in his assessment.

Additionally, according to a psychiatric report from her defense team, Fleming thought her actions were necessary to “cleanse her children.”

The incident in question occurred during a night in November 2022, when a staff member at the Bronx shelter called 911 due to smoke and water coming from Fleming’s apartment.

Fleming had been living at the shelter after working at a concession stand in Queens. She had previously been hospitalized for two months for major depressive disorder, where she was prescribed medication, according to court documents. Unfortunately, she didn’t take her medication as directed and reportedly used marijuana regularly, which may have worsened her mental health issues.

On that fateful night, authorities found her “naked from the waist up, sitting on a bed and holding a children’s book upside down.” Investigators later discovered that she had repeatedly stabbed her sons and submerged them in the bathtub.

At the time, police sources indicated that Fleming confessed to the killings and mentioned the “devil” to detectives.

In contrast to the strong push for murder charges in the Lindsay Clancy case, prosecutors in Fleming’s situation argued that pursuing murder charges would be inappropriate. Judge Audrey Stone’s ruling came through a plea deal for Fleming.

Bronx assistant district attorney Tiffany Wichman commented, “Prosecuting mothers does not and cannot prevent these crimes from happening, but public discourse might,” emphasizing the importance of continued conversations around these incidents.

Fleming is expected to be re-evaluated by court-appointed psychiatrists and will return to court on September 18. While she has avoided jail time, she could still face months, or even years, in a mental health facility.

The father of the deceased children, Columbus Canada, was present at the verdict and expressed that he has forgiven Fleming, stating, “She’s a good person. She was a loving person. She loved kids.”

This case has drawn comparisons to the high-profile trial of Lindsay Clancy in Massachusetts, where the jury will soon reconvene to decide her fate. Clancy’s defense team has argued for a not guilty verdict based on her insanity during the alleged murder of her three children while she was reportedly experiencing postpartum psychosis and was on multiple powerful medications.
