The Public Interest Law Foundation (PILF) is suing election officials in California’s Alameda County, which includes the cities of Oakland and Berkeley, for refusing to disclose foreign nationals on their voter rolls who have voted in past elections. .
PILF filed a lawsuit this month against Alameda County Voter Registrar Timothy Dupuis, alleging that he violated the National Voter Registration Act (NVRA) by failing to provide all records of foreign national votes in the area.
“For more than four months, we have been trying to obtain records of foreign nationals on the voter rolls,” says PILF President J. Christian Adams. Said:
Alameda County’s lack of transparency is a concern as we enter a presidential election year. The public has the right to inspect election records, including important records that reveal mistakes and errors by election officials. [Emphasis added]
Last September, PILF asked Alameda County Elections officials for all records showing the number of aliens who had their voter registrations revoked, as well as records of each alien who voted before their registrations were cancelled.
The next month, PILF notified Dupuis that his office was violating the NVRA, which requires counties and states to turn over voter rolls and voting history records. Dupuis’ office has indicated that it intends to release any such records to PILF by mid-January 2024.
However, PILF attorneys said they have not yet received a response from Alameda County.
Although it is not uncommon for foreigners to register to vote, record show. For example, since 2021, nearly 200 foreign nationals have been removed from the voter rolls in Pima County, Arizona, and 65 percent of them were added to the voter rolls thanks to third-party registration drives.
Similarly, more than 220 foreign nationals have had their voter registration canceled in Maricopa County, Arizona, since at least 2015. One of the foreign nationals had been on the county’s voter rolls for nearly 30 years.
The case is Public Interest Law Foundation v. Dupuisno. 3:24-cv-00679-LB United States District Court for the Northern District of California.
