Can the US really strip Ilhan Omar of her citizenship?

U.S. Representative Ilhan Omar (D-Minn.) recently spoke at an event in Minneapolis about the emerging Republic of Somaliland’s efforts to secede from the larger Somali nation. In her speech, she assured the predominantly Somali audience: she “I am Somali first and Muslim second.” She too told them They said, “I can sleep easy knowing that I am here to protect Somalia’s interests from within the American system.”

Prominent Republicans immediately began calling for Omar to be removed from Congress, denaturalized, and deported from the country. And of course, what our country needs most is Manchurian candidate Serving the interests of unstable terrorist havens like Somalia from within the US Congress.

But can Omar’s words translate into action? The answer to that question is complicated.

Give the keys to the Roman gates to the Visigoths and the empire will inevitably fall.

The Immigration and Nationality Act allows for the deprivation of nationality from foreign nationals in certain areas. limited circumstances. Aliens who commit certain acts (such as fraudulent naturalization, declaring allegiance to a foreign country, possessing arms against the United States, or treason) may be tried in federal court and stripped of their citizenship. This process is known as “denaturation.”

However, as a result of a complex intertwining of judicial decisions and executive branch policies, it has become increasingly difficult to strip citizenship from people who should not have been naturalized in the first place.

First Amendment Shield

So what happens to Omar? established track record Who is cutting back on anti-American rhetoric and sometimes appearing to work harder for violent terrorist organizations like al-Shabab and Hamas than for the American people?

There are certainly plausible arguments that Omar’s comments violate the law. oath of allegiance She took this photo when she was naturalized. That oath states, “I do hereby declare under oath that I absolutely and completely renounce and renounce allegiance and allegiance to any foreign prince, power, nation, or sovereignty of which I have heretofore been a subject or citizen. …” begins.

The oath concludes with the statement that individuals “freely assume this obligation without any mental reservation or purpose of avoidance.” And Omar’s statements seem to indicate that she had mental reservations about taking her vows.

Nevertheless, American courts have generally required that abstract mental states be proven by evidence of behavior consistent with an inferred thought process. At this time, there is no evidence that Mr. Omar has engaged in any activity that would pass classified information to Somalia or to terrorist organizations.

Therefore, the reviewing court held that Mr. Omar’s statements that he “puts Somalia first” and that Mr. Omar “defends” the “interests of Somalia” are political speech protected by the First Amendment. It is likely to be interpreted very broadly as not being grounds for denaturalization. And in any case, the Biden administration, which is ideologically aligned with Omar, is unlikely to take any legal action against her.

A more likely route to stripping Omar of her citizenship may be continued claims that she committed fraud to help relatives gain access to the United States.

She is accused of marrying Ahmed Nur Said Elmi. seems to be her brother – while still legally married to her first husband – to obtain his green card. Omar has publicly claimed that Elmi is not his brother, but has not provided any documents or other information that would resolve the issue.

If the allegations are true, Omar would be guilty of incest, bigamy, and bigamy. immigration fraud. If convicted of any of these three charges, she would likely be subject to expulsion from Congress, degeneration, revocation of her green card, and deportation from the United States. However, the F.B.I. is said to have investigated The department has not released any findings regarding these issues.

And, again, it appears that the Biden administration has no intention of pursuing these types of charges or assisting state authorities in filing them.

disaster waiting to happen

By all accounts, Ilhan Omar has repeatedly shown that she neither likes nor respects the country that took her family in as refugees and showed her the path to success. Therefore, whether she is promoting her own interests or the interests of her beloved Somalia, a country riddled with terrorists from Al-Shabab, one of the most dangerous jihadist organizations in the world. It is reasonable to conclude that he ran for Congress in

The Ilhan Omar case should therefore serve as a wake-up call for American lawmakers and legal scholars. Making it virtually impossible to denaturalize foreigners who don’t deserve U.S. citizenship in the first place is a recipe for disaster. Give the keys to the Roman gates to the Visigoths and the empire will inevitably fall.
