Rep. Chip Roy (R-Texas) plans to meet with House Republicans on Tuesday to raise the option of using the 25th Amendment to the Constitution regarding President Biden’s eligibility.
Roy told Fox News he thinks Republicans need to clarify their position on Biden’s capabilities.
Section 4 of the 25th Amendment to the Constitution lays out a set of procedures for removing the President from office if he or she becomes incapacitated.
However, a resolution on the 25th Amendment cannot be brought to the House floor immediately.

Because the bill targets the executive branch and not Congress, it will not be a “privilege” bill and will go directly to the legislative front.
Impeachment, on the other hand, is considered “prerogative” because the power is enumerated in the Constitution as a prerogative of Congress.

A senior House Republican source told Fox News that any resolution on the 25th Amendment would first have to go through committee.

Roy’s plan was announced a week and a half after House Speaker Mike Johnson, a Louisiana Republican, said his Cabinet was considering a 25th Amendment provision for Biden.
