Legal Action Grows Over Gender Reassignment Surgeries on Minors

A lawsuit targeting medical professionals who conduct gender reassignment surgeries for minors has gained traction after a jury awarded $2 million in a recent verdict. Chloe Cole, a detransitioner advocating for similar cases, emphasized that this ruling could establish an important precedent.

The plaintiff, Fox Varian, underwent a double mastectomy at the age of 16. Now identifying as an adult who no longer considers himself transgender, Varian argues that he lacked the mental maturity to make such significant medical decisions as a minor.

On January 30, a jury in New York found two doctors liable for medical malpractice due to their failure to follow essential protocols in assessing whether irreversible surgery was appropriate for Varian.

Healthcare System Under Scrutiny

Cole expressed that this ruling might influence future cases involving individuals who regret medical interventions they pursued as minors. Currently, she is pursuing her own lawsuit associated with her gender transition, which began when she was just 12.

During an appearance on “Fox & Friends Weekend,” Cole stated, “We finally have institutional support for the idea that these procedures, especially surgeries, are harmful to children.” This comment followed recent recommendations from the American Society of Plastic Surgeons (ASPS) advocating for a pause on sex reassignment surgeries for young patients.

Cole also noted the significance of having case law available for lawyers representing transition patients seeking justice.

Guidance from Medical Professionals

Recently, the ASPS updated its guidelines, suggesting that gender-related surgeries—like breast, genital, and facial surgeries—be postponed until patients reach at least 19 years of age. The organization indicated a lack of solid evidence showing that these procedures provide a beneficial risk-to-reward ratio.

In light of recent legal rulings and evolving medical guidance, Cole anticipates a potential influx of lawsuits. “These lawsuits will flood the courts, and doctors will recognize the significant responsibility they bear regarding these procedures. They will likely stop performing them on children,” she said.
