Pregnancy Test Leads to Unexpected Ordeal for Nicola Packer

When Nicola Packer took a pregnancy test in November 2020, she honestly didn’t believe she was pregnant. After all, the country was locked down due to the pandemic, and she was 41—closer to menopause than motherhood. Feeling unwell, she thought it was more likely just a bug. A friend, who was assuming she might be expecting, nudged her into taking the test, and she jokingly aimed to “prove him wrong.”

But then came the shock: the test came back positive. Although she was surprised, she knew right away that motherhood wasn’t in her plans. Without hesitation, she sought an abortion. During the pandemic, regulations had allowed abortion medications to be sent by post after remote consultations, which made the process somewhat easier for her.

Packer took the pills thinking it would be a straightforward situation. However, hours later, she unexpectedly delivered a small but fully formed baby. This event was deeply traumatic, yet it took a darker turn when she ended up bleeding heavily and had to visit the A&E at Charing Cross Hospital. Instead of receiving care, she was told she needed to go to another hospital, so she had to stay there without an ambulance.

She brought the fetus with her but hesitated to disclose that she had taken abortion pills. She feared she might face repercussions. When the staff learned about the pills later, a midwife assured her of their commitment to her well-being, but soon, police were involved.

A uniformed officer showed up while she was still recovering from the birth, leading to her arrest. In a distressing turn of events, her phone and computer were taken as evidence. This was just the start of a four-and-a-half-year legal struggle that culminated in her giving evidence at a trial lasting two weeks.

Throughout the trial, Packer maintained a calm demeanor, despite being subjected to intense personal questioning. The prosecutor delved into one of the most painful experiences of her life, prompting her to recount details she’d rather forget. Sometimes composed, she also broke down in tears, supported by a close-knit group of friends who were there for her in and out of the courtroom.

The atmosphere was so charged that at one point the judge had to ask the audience to step out to ensure Packer felt supported. As the proceedings reached their conclusion, Fiona Hollick, her lawyer, noted that her client felt “completely hurt,” articulating that the circumstances were tragic but shouldn’t have been criminalized.

The experience has changed Packer irreversibly. Her personal life, including intimate moments and even medical history, was laid bare. This was evident when photos were displayed in court, presented to argue her case regarding the pregnancy, which made the experience all the more humiliating.

In the coming days, there were discussions aimed at assessing whether there was a public interest in pursuing a trial four and a half years after the incident. Legal experts raised concerns regarding how confidential medical details were mishandled during the proceedings.

Calls for reform regarding abortion laws have emerged in light of her ordeal, with some lawmakers advocating for changes this summer to decriminalize abortion, which continues to be a contentious issue in the UK.

MP Tonia Antoniazzi, who attended part of the trial, expressed her relief that Nicola had avoided serious penalties but condemned the treatment she endured throughout the legal process. Packer’s case serves as a stark reminder of how outdated laws can deeply affect women’s lives, emphasizing the uncomfortable truth that laws surrounding abortion are still resonant with rules that were written long before women had the right to vote.

In Packer’s own words, her journey included being taken from her hospital bed to police custody, experiencing delays in urgent medical care, and spending every cent she had on legal defense. The broader implication raises alarms about systemic failures that can harm vulnerable women and girls, underscoring a dire need for reform.
