Lululemon Takes Legal Action Against Costco
Lululemon is pursuing legal action against Costco, alleging that the retailer is infringing on its patents by selling knockoff versions of its clothing, including pants, hoodies, and jackets.
The lawsuit, filed recently, claims that Costco is exploiting Lululemon’s brand reputation by offering products that mimic the unique design elements and trade dress of Lululemon’s apparel. The legal complaint labels these offerings as fraudulent and unauthorized.
Specifically, Lululemon has accused Costco of imitating the designs from its ABC line of pants, the Define jacket line, and the scuba zip-up hoodies. There are concerns that Costco might be intentionally misleading customers into thinking that these clothes are somehow associated with Lululemon under Costco’s private label.
Aside from wanting Costco to halt sales of these alleged imitations, Lululemon is also seeking unspecified financial damages. As of now, Costco has not publicly responded to the lawsuit.
This legal battle comes on the heels of articles published by notable sources that highlighted the striking similarities between Lululemon’s products and what Costco offers. A piece in the Washington Post discussed how social media users were pointing out these “dupes” to their followers.
One user noted that “people just eat it up,” referring to the enthusiasm for Costco’s knockoff items. Similarly, an article in the New York Times compared the ABC Pants to a Kirkland version and concluded that while there are similarities, Lululemon’s designs are more refined.
Despite the controversy, Lululemon seems determined to establish itself in the competitive athletic retail market. A spokesperson emphasized the company’s commitment to protecting its intellectual property, stating, “We will pursue appropriate legal action as needed.”
