Court decides Meta does not hold a monopoly in social networking

Federal Judge Rules Meta Does Not Hold Illegal Monopoly

A federal judge determined on Tuesday that Meta does not illegally monopolize personal social networking. The ruling indicates that the tech giant faces competition from a wider social media market, which includes platforms like TikTok and YouTube.

U.S. District Judge James Boasberg, in a detailed 89-page decision, highlighted the swift evolution of technology, noting that the social media environment has “changed significantly” since the Federal Trade Commission (FTC) initially filed its antitrust case five years ago.

“Like Heraclitus’ river, the social media torrent is rushing so fast that the court has never tried the same case twice,” Boasberg remarked, adding that both Meta’s applications and its competitors have consistently evolved.

The FTC had filed a lawsuit against Meta in 2020, during the first Trump administration, claiming that the company solidified its monopoly on social networking through acquisitions of Instagram and WhatsApp. The agency argued that Meta dominated a market that extends beyond personal social networking to include platforms like SnapChat and MeWe.

However, Meta asserted that it competes with a broader array of platforms, particularly highlighting TikTok’s rapid rise in popularity. Ultimately, Boasberg sided with Meta in the ruling.

“As apps proliferate and recede, shift from one trend to another, and continue to roll out new features, it’s understandable that the FTC struggles to delineate the boundaries of Meta’s product market,” the judge stated.

He also noted that although Meta might have had monopoly power in the past, the agency needs to demonstrate that it currently maintains such power.

Meta responded positively to the ruling, emphasizing the competitive environment it navigates. A spokesperson for the company mentioned, “Our products are beneficial to people and businesses and represent American innovation and economic growth.” The spokesperson expressed eagerness to collaborate with the administration while committing to investment in America.
