A lawsuit initiated by three Minnesota softball players seeking to allow biological male pitchers to compete has reached its first court hearing this week.

US District Judge Eric Tostrud presided over the oral arguments from attorneys representing the players, who are requesting a preliminary injunction aimed at barring transgender athletes from participating in women’s sports within the state. One attorney for the plaintiffs stated that current policies in Minnesota are in violation of Title IX.

“This situation fundamentally takes away athletic opportunities from women in sports that necessitate competitive skills and physical contact, by allowing men into those spaces,” said Hal Frampton, a senior adviser at Alliance Defending Freedom.

The plaintiffs are hopeful that the lawsuit will lead to significant changes in the state’s sports regulations. “We aim to secure a ruling that the bylaws of the Minnesota State High School League violate Title IX by permitting men who identify as female to participate in women’s sports,” Frampton noted.

This lawsuit involves several parties, including Minnesota Attorney General Keith Ellison, the executive director of the Minnesota State High School League, Erich Martens, and the commissioner of the Minnesota Department of Human Rights.

One anonymous player voiced frustration about facing a transgender athlete who played a significant role in leading Champlin Park High School to a state championship this season. “It’s not merely a physical challenge; it’s also a mental struggle. I feel he has an edge in the sport that I’ve grown up playing,” she expressed.

“This situation has impacted me in ways I never anticipated. It’s simply unjust, and it’s infuriating that nothing seems to change. Boys shouldn’t be able to take a girl’s spot on a team just because they can,” she added.

An anonymous player criticized Attorney General Ellison for being a staunch advocate for allowing transgender athletes in women’s sports. Ellison has, at times, opposed federal actions aimed at restricting transgender participation.

“It’s really disheartening to see that he doesn’t take the rights of girls and women seriously. Allowing boys to compete against girls isn’t safe and feels utterly unfair. It’s frankly disgusting to know AG Ellison backs policies that disadvantage women,” the player remarked.

Earlier this year, the Minnesota Legislature did not pass proposed “Saving girls’ sports laws,” which aimed to limit participation in female-designated teams to women and girls. Now, the lawsuit is setting out to achieve similar goals.
