Don Lemon’s Lawsuit Against Elon Musk’s X Moves Forward
A judge in San Francisco has allowed Don Lemon to proceed with his lawsuit against Elon Musk’s social media platform, X, following the abrupt cancellation of his show. The lawsuit, which also names former CEO Linda Jaccarino, was triggered by the sudden end of a content deal that Lemon believed would launch his show on the platform.
Superior Court Judge Harold Kahn has permitted Lemon to pursue claims including fraud, misappropriation of name and likeness, and breach of contract, while dismissing several other allegations, such as misrepresentation and harassment. Lemon’s attorney, Carney Shegalian, expressed that this ruling enables them to hold Musk and X accountable in court, emphasizing that everyone is subject to legal proceedings.
The lawsuit stems from a partnership agreement that Lemon claims was established in December 2023. According to court documentation, the deal included a payment of $1.5 million, along with a significant cut in advertising revenue and bonuses based on the show’s follower count. This arrangement was contingent upon Lemon announcing the partnership at the CES conference in January, a strategic move aimed at attracting advertisers.
However, after a contentious interview with Musk on March 8, 2024, which was intended to kickstart Lemon’s new show, Musk abruptly canceled the contract. Lemon alleges that Musk informed his agents via text that the contract was no longer valid. Furthermore, Brett Weitz, X’s head of content and talent sales, reiterated that there was no formal agreement, discrediting the earlier assurances made to Lemon.
The judge’s ruling allows Lemon to focus on his breach of contract claims and also provides him an opportunity to clarify his claims, as his original lawsuit did not indicate whether the contract was verbal, written, or implied. The dismissal of Lemon’s claims regarding honor and loss seems to have been influenced by comparisons made to a character from Roald Dahl’s Charlie and the Chocolate Factory.
