Texas Appeals Court Acquits Former Officer in Shooting Case

The Texas 7th Circuit Court of Appeals has overturned the conviction of former Austin police officer Christopher Taylor, who had been sentenced to two years for his involvement in an on-duty shooting.

The court’s ruling primarily focused on whether Taylor could have reasonably believed that deadly force was necessary when confronted by a man wielding a knife. The jury ultimately found that he could not, and the court’s opinion highlighted that the legal and factual record supported this conclusion.

Initially, Taylor had faced murder charges following the 2019 death of 46-year-old Maurice DeSilva but was later convicted of manslaughter instead. DeSilva had been experiencing a mental health crisis, brandishing a knife against himself amidst a series of distressing behaviors, which posed challenges for the responding officers.

The case record detailed that when officers arrived at the scene, they were met with DeSilva threatening self-harm. Body camera footage revealed the tension as he approached the officers after being told to drop the weapon. Despite some commands yelled by the officers, the situation escalated and resulted in multiple shots being fired, leading to DeSilva’s death.

After the appellate court’s decision was announced, Michael Block, the president of the Austin Police Association, expressed that the ruling underscored the problematic nature of how District Attorney Jose Garza handled the case, suggesting that Garza pushed the case repeatedly until a jury was ultimately biased against Taylor.

Block extended gratitude toward the appellate court for recognizing the flaws in the prior judgment, implying the importance of allowing officers to operate without the looming threat of politically motivated prosecutions.

Additionally, Taylor’s attorney celebrated the decision, contending that the use of force in this incident was both lawful and warranted under the circumstances.

This latest development comes amidst ongoing controversies surrounding law enforcement policies in Austin, where Garza has faced scrutiny for his approach to policing and the prosecution of officers.
