
Manhattan District Attorney Alvin Bragg (Democratic) contempt motion on Monday against Donald Trump (R), claiming the former president violated a judge’s gag order. Daily Caller News Foundation report.
Last year, Mr. Bragg indicted Mr. Trump on 34 felonies for falsifying business records in an attempt to conceal payments to keep his affair with porn actress Stormy Daniels quiet. Trump’s former lawyer Michael Cohen claims he paid Daniels $130,000 at Trump’s request. The former president has pleaded not guilty to all charges and denied allegations of extramarital affairs.
Acting Judge Juan Mercian previously imposed a gag order on President Trump, prohibiting him from speaking publicly about anyone involved in the case, including his family.
Trump’s lawyers have repeatedly tried to have Marchand recuse himself from the case, citing “actual disputes” and allegations of “unacceptable misconduct.” Trump’s lawyers argued that Marchand’s daughter “has a direct financial interest in these cases through her ownership and leadership role” in the progressive political consulting firm.
Bragg said the former president violated a judge’s gag order and posted several statements on Truth Social, one of which referred to “two scumbags.” Prosecutors argued the post referred to potential witnesses, Daniels and Cohen.
In Monday’s court filing, Bragg urged a judge to tell Trump he could face prison time if he violates the gag order. He called on President Trump to treat his recent social media posts with contempt.
“The court should recommit defendants to comply with their obligations under the order,” Bragg wrote. “And finally, this court warns the defendant that future violations of the court’s restrictions on extrajudicial speech may result in up to 30 days in prison, as well as additional fines. Should.”
“To protect the integrity of the ongoing trial, it is critical that Defendants immediately cease any conduct that violates the narrow limitations of the April 1 Order,” the complaint continued. “A finding of criminal contempt, the imposition of sanctions, and a stern warning from this court are the minimum remedies necessary to achieve this essential objective.”
“The court should now hold the defendant in criminal contempt for willfully disobeying a legal order,” Bragg’s filing added. “Defendants are not above the law and cannot simply ignore judicial orders that upset them.”
