Justice Department Faces Scrutiny Over Prosecutions Involving Non-Citizen Criminals

The Justice Department is coming under fire for supporting Democratic prosecutors who seem lenient towards criminals, especially non-citizens, raising concerns about potential discrimination in legal proceedings.

Steve Descano, the Commonwealth’s Attorney for Fairfax County since 2019, has been associated with organizations funded by George Soros. His office has gained notoriety for its reportedly lackluster efforts in prosecuting illegal immigrants, a failure that has led to tragic outcomes.

For instance, Descano’s office decided to drop a felony charge against Wilmer Osmany Ramos Giron, an undocumented Guatemalan immigrant accused of kidnapping and strangling the mother of his child. Astonishingly, he received a plea deal that allowed him to spend just two months in detention, despite having a history of multiple deportations and gun-related arrests.

This complacency led to further devastation. Abdul Jallow, another illegal immigrant from Sierra Leone, had an extensive criminal record with over 30 arrests for serious offenses, including assault and drug-related crimes. Even after numerous felonies against him were dropped, he went on to allegedly stab a U.S. citizen, Stephanie Minter, to death.

The Victims’ Rights Reform Council has highlighted the warnings provided to Fairfax County prosecutors about Jallow, citing a “blatant disregard for human life” that ultimately contributed to the tragedy.

In an internal communication, a police major expressed concerns about Jallow’s early release, questioning why he was let go so swiftly. The major noted the urgent need for proactive measures to ensure public safety.

Jallow was ultimately convicted of a violent stabbing incident in 2023 and sentenced to seven years, though five years of that was suspended.

Concerns surrounding Descano’s policies are mounting. Assistant Attorney General Harmeet Dhillon indicated in a recent letter that Descano’s office is under investigation for engaging in unlawful discrimination, potentially violating federal laws meant to ensure fair treatment.

The investigation targets specific policies initiated by Descano in December 2020 that seem to favor undocumented immigrants over legal citizens in prosecutorial decisions. These policies mandate prosecutors consider the immigration consequences for defendants and the potential negative impacts on families affected by deportation.

Descano has defended his approach, emphasizing a desire to avoid causing undue suffering for immigrant families while asserting that his office’s policies align with community values. However, many believe he should prioritize the safety of citizens over leniency towards criminals.

In his beliefs, tough-on-crime policies are seen as short-sighted, and he has declared his practices as fair and lawful. Still, the balance between justice and compassion remains a point of contention, raising questions about the priorities of local prosecutors.
