House Democrats Urge DOJ to Halt Investigation into Rep. Ilhan Omar
Over 170 House Democrats are calling on the Department of Justice (DOJ) to discontinue its investigation into Rep. Ilhan Omar’s (D-MN) immigration status.
In a letter to Attorney General Todd Blanche and Department of Homeland Security (DHS) Secretary Markwayne Mullin, the Democrats express concern regarding this month’s raid on Omar’s home in Washington, D.C. and the scrutiny of her immigration history, which they liken to the “weaponization” of the DOJ.
“We write to express our unequivocal opposition to your raid of Congresswoman Ilhan Omar’s home. We are profoundly alarmed by your weaponization of federal law enforcement against her and demand you refrain from taking any further actions that could affect the outcome of any upcoming election,” the letter states, spearheaded by Reps. Jamie Raskin (D-MD) and Pramila Jayapal (D-WA).
This weaponization of law enforcement to harass a sitting Member of Congress 22 days before an election is unprecedented and unacceptable. The DOJ has maintained a long-standing policy of avoiding investigative actions related to candidates close to elections unless a delay would jeopardize a criminal investigation. This policy was invoked by Attorney General Blanche as far back as nine months before an election. Congresswoman Omar is up for reelection in Minnesota’s 5th congressional district in just one week. News of the search warrant, whether justified or not, could impact voter choices, which is why federal law enforcement should not engage in this kind of conduct when ballots are being cast. This type of interference strips Minnesotans of their right to a free and fair election guaranteed to them under the Constitution.
Your actions appear driven by a predetermined political outcome rather than an objective pursuit of justice. The investigation focuses reportedly on her father’s immigration paperwork, filed when Omar fled Somalia’s civil war at eight, resulting in her becoming a U.S. citizen at seventeen. This certainly doesn’t warrant a pre-dawn raid for documents related to her minority status. Interestingly, the Trump Administration had previously investigated this very issue in 2019 and found no evidence of wrongdoing. Nevertheless, some officials from that administration are continuing to make unsubstantiated claims of criminal behavior. Earlier this year, Vice President J.D. Vance preemptively accused her of “definitely committing immigration fraud” and urged White House advisor Stephen Miller to pursue her even before the DOJ or DHS concluded their investigation. Secretary Mullin hinted at this raid last month, stating, “something’s going to happen” with Congresswoman Omar. Following the raid, Miller’s wife posted a now-deleted message celebrating the development, saying, “Promise made, promise kept.” This kind of political maneuvering should not intersect with federal law enforcement actions, yet here we are.
Jayapal has mentioned the possibility of taking legal action against the Trump administration if Democrats gain control of the House in next month’s elections concerning the investigation into Omar.
“We will actively and aggressively investigate this case,” Jayapal remarked. “We will probably put forth legislation to ensure no funds are used for this investigation.”
Raskin proposed that Democrats might even consider cutting funding to specific agencies to make sure no funds are allocated for the Omar investigation.
The DOJ and DHS continue to examine Omar’s immigration history, including claims that she allegedly married her brother, Ahmed Nur Said Elmi, to assist him in obtaining U.S. immigration status.
In a recent legal document from U.S. Attorney Jeanine Pirro, Omar was referred to as “Ilhan Nur Said Elmi,” which seems to imply that federal prosecutors believe she shares a last name with her ex-husband.
When asked in an interview last week if she is related to her ex-husband, Omar replied, “Not to my knowledge.”
During the raid on Omar’s home last week, federal investigators reportedly seized 17 items and collected DNA, which they hope will demonstrate that she committed immigration fraud.
In addition to the immigration fraud investigation, she is also being scrutinized by Pirro’s office for potential financial crimes, following reports of her multimillion-dollar net worth.
