Virginia Democrats Propose Drone Bill for Environmental Enforcement

Democrats in Virginia are pushing forward a new bill that would give the Department of Environmental Quality the authority to operate drones without a warrant. This maneuver aims to better enforce various environmental regulations.

This proposal, put forth on January 13, adds to existing provisions that permit state agencies to utilize drones without needing a warrant for specific situations, like searching for missing children or for certain criminal investigations. The new amendment specifically allows the Department of Environmental Quality to use these unmanned aircraft for tasks related to water and wetland protection, as well as erosion and sediment control.

The language in the bill defines “unmanned aircraft” as those operated without direct human control, while an “Unmanned Aircraft System” includes the aircraft and its components, such as communication and sensing equipment.

Democratic State Representative Alfonso Lopez is behind this amendment, although he hasn’t yet responded to inquiries regarding its implications.

The amendment aims to add the Department of Environmental Quality to the exceptions list for operating unmanned aircraft in line with maintaining erosion and sediment control, particularly in areas not covered by certain water management programs in the state.

Additionally, Governor Abigail Spanberger has pointed out that moderate Democrats are currently introducing a series of bills that reflect progressive values. These proposals range from including LGBTQ+ history in school curriculums to expanding parole options for prisoners.
