Detransitioner awarded $2 million after suing New York doctors who advocated for double mastectomy

A 22-year-old woman, who identified as male during her teenage years, has been awarded $2 million in a significant lawsuit against New York medical professionals who mandated a double mastectomy while she was still a minor.

Fox Varian underwent this transformative surgery at 16, with the consent of both a psychologist and a surgeon. However, on January 30, a jury deemed both doctors culpable for medical malpractice, as reported.

Now 22 and recognized as a “transitioner,” Varian will receive $1.6 million for both past and future suffering, alongside an extra $400,000 to cover forthcoming medical costs. This marks the first medical malpractice victory on behalf of a transitional patient in the U.S.

The jury in Westchester County Supreme Court found psychologist Kenneth Einhorn and surgeon Simon Chin liable for pressuring a minor into permanent surgical solutions for what they termed “gender dysphoria,” disregarding established care standards.

Varian’s legal team accused Einhorn of heavily influencing her, essentially suggesting that surgery was necessary to address her feelings about gender. Varian’s mother, Claire Deacon, testified she opposed the operation but felt compelled to consent due to fears for her daughter’s life.

Deacon expressed, “It felt like I was being pushed so hard that clear decision-making was tough.” She added, “I don’t think there was malice; perhaps the doctor genuinely believed in what he was advocating, though he was mistaken.”

In sealed court documents, Deacon noted the surgery left Varian physically unwell and deeply discontented.

The jury focused on whether the medical professionals acted appropriately, rather than evaluating the ethical implications of performing gender-related surgeries on minors.

Defense attorneys claimed that Varian reportedly lived contentedly as a man for several years post-surgery before initiating the lawsuit in 2023. They further maintained that Varian had used male pronouns, identified as a “trans man,” and suggested the concept of surgery herself.

Her lawyers contended that doctors should have evaluated Varian for other potential mental health issues, like depression or body dysmorphic disorder, before proposing surgery.

This case surfaces nearly a year after former President Trump implemented restrictions relating to gender-related medical treatments for minors facing gender dysphoria. Currently, there are 28 similar transitioner cases progressing through the courts across the United States.
