DHS Official Criticizes Abrego Garcia’s Social Media Presence Amid Legal Battles
On Saturday, Tricia McLaughlin, an Assistant Secretary at the Department of Homeland Security (DHS), called out Kilmer Abrego Garcia for allegedly “creating TikTok” while in custody, attributing this to an “activist judge.”
This remark followed a one-minute video showing Abrego Garcia, an undocumented immigrant from El Salvador linked to a significant deportation initiative during the Trump administration, lip-syncing to a song in Spanish. McLaughlin expressed frustration, stating, “So, we… [DHS] has been given a gag order by an activist judge, and Kilmer Abrego Garcia makes TikTok. When arbitrators silence law enforcement and give a megaphone to those who oppose our legal system, America’s judiciary becomes dysfunctional.”
Judge Blocks Custody Remand but Sentencing Could Happen Soon
A federal judge, appointed by President Obama, had previously restricted DHS and other Trump administration officials from discussing Abrego Garcia’s case publicly. This gag order was reportedly updated after prosecutors flagged that it affected nearly 300,000 DHS employees.
Abrego Garcia has consistently pushed back against public criticisms aimed at Trump administration officials, arguing these comments could jeopardize his right to a fair trial.
Abrego Garcia Released After Court Ruling
His situation has gained national attention since March, when he was sent back to El Salvador against a previous court mandate, which the Trump administration later described as an “administrative error.” After returning to the U.S., he was taken into federal custody over human smuggling charges linked to a 2022 traffic stop. The administration alleges he is affiliated with MS-13, a claim he denies.
This week, a federal judge canceled his trial and scheduled a hearing to assess whether prosecutors had been diligent in pursuing the human smuggling allegations.
U.S. District Judge Paula Xinis also extended a temporary restraining order preventing the Trump administration from promptly re-detaining Abrego Garcia, due to their failure to submit a final removal order.
The ruling reaffirmed a previous decision securing his release from ICE custody. DHS and Abrego Garcia’s attorney didn’t respond immediately to inquiries for comment.
