Disgraced Baltimore Former DA Marilyn Mosby Avoids Jail for Fraud, Perjury

Former Baltimore District Attorney Marilyn Mosby, who was convicted of fraud, could have faced up to 40 years in prison for perjury and mortgage fraud, but will avoid prison time.

U.S. District Judge Lydia Kay Grigsby said her decision was motivated by the fact that Mosby is the mother of two young girls. She also lied about receiving a $5,000 gift from her then-husband, Baltimore City Council Speaker Nick Mosby, to obtain the mortgage. Prosecutors presented evidence showing that she wired the funds to her husband and then sent the money back to herself to make it look like a gift.

The disgraced district attorney lost his 2022 reelection bid following the indictment, but Nick Mosby said he “made mistakes” following his ex-wife’s conviction, saying he’s “not a perfect person,” even though he wasn’t charged.

“Two juries have concluded that you did something wrong and breached the public trust, and that’s going to be very difficult to recover from,” Judge Grigsby told Judge Mosby during Thursday’s sentencing hearing.

The judge said Mosby had repeatedly victimised people through dishonest behaviour “albeit not in the traditional sense”.

“Defendants have an absolute right to maintain their innocence and should not be punished in any way for it,” Grigsby said.

Mosby had several character witnesses, including progressive civil rights attorney Ben Crump.

“Sentencing her to prison for a minor, victimless, non-violent crime would be a grave injustice and would compound the trauma for her two beautiful daughters,” he said in a statement. “At the heart of this issue is a minor, white-collar crime for which so many others have been convicted and received only light sentences.”

After the acquittal, Mosby and her young daughters tearfully thanked their supporters outside the courtroom, with the former prosecutor saying, “Thank you. I can honestly say that God sent an angel to see me at a time when I felt like I wasn’t being seen. I am so grateful to each and every one of you.”

One of her daughters took the stage and told reporters that the ordeal inspired her to become a prosecutor when she grew up.

Shortly before his sentencing, Mosby was ordered to forfeit the Longboat Key condominium he rented out for profit, with more than 90 percent of the proceeds now going to the federal government.

She still maintains her innocence and has asked President Joe Biden for a pardon.
