Disney has filed a lawsuit against the Federal Communications Commission (FCC), claiming that the agency is violating the First Amendment in its efforts to fast-track the license renewal process for ABC stations.
The FCC, led by Chairman Brendan Carr, is pushing to renew the licenses for eight ABC stations earlier than planned. Originally, these licenses were to be renewed between 2028 and 2031, but the FCC is accelerating the timeline due to ongoing conflicts between the Trump administration and Jimmy Kimmel, the host of ABC’s late-night show.
In the lawsuit, Disney argues that the ABC stations must demonstrate they are operating in the public interest, which ties into the company’s current evaluation of diversity, equity, and inclusion (DEI) efforts. Disney contends that the Trump administration has specifically targeted ABC through a “retaliation campaign” aimed at limiting its broadcast content.
Additionally, ABC intends to seek a temporary restraining order along with a preliminary injunction regarding this matter.
The FCC has not yet provided a comment on the lawsuit’s developments. However, an FCC representative previously remarked that for many years, Americans have subsidized broadcast media significantly by allowing TV stations to use airwaves, which are a public resource, for free. In exchange, broadcasters are mandated to operate in the public’s interest, rather than serving the narrow agendas of political entities.
Moreover, the spokesperson emphasized that broadcasters are not allowed to engage in discriminatory practices concerning DEI, must follow equal political opportunity rules, and cannot propagate misinformation or distort the news. The FCC aims to enforce these standards strictly, regardless of any disinformation campaigns that some broadcasters may choose to pursue.
