California has been accused of gender discrimination by permitting transgender-identifying men to participate in women’s sports and use female bathrooms and locker rooms.
The Department of Education’s Office of Civil Rights (OCR) announced on Wednesday that their investigation involving the California Department of Education (CDE) and the California Interscholastic Federation (CIF) found “clear violations” of Title IX, which prohibits gender-based discrimination in educational programs receiving federal funds.
Governor Gavin Newsom has faced criticism for allowing men to compete in women’s sports recently, which some argue undermines female athletes and raises concerns about educational integrity and fairness.
The Trump administration has been proactive in enforcing Title IX protections for women and girls. The findings indicated that California is not fulfilling its obligations under federal law, suggesting states must align with Title IX to avoid repercussions.
The Department of Education has proposed a resolution agreement with CDE and CIF, emphasizing that they must either voluntarily comply with Title IX or risk enforcement actions, which could include referrals to the Department of Justice for legal action.
As part of this agreement, there may be efforts to restore records and titles to female athletes who were affected by male athletes competing in their events, along with issuing personalized letters of apology from California to these female athletes.
On February 5th, Trump reaffirmed his commitments by signing an executive order titled “Keep men away from women’s sports,” underlining that organizations receiving federal funds cannot limit equal opportunities for women in sports.
The order establishes a US policy aimed at safeguarding opportunities for women and girls, and aims to eliminate educational programs that compromise their rights and privacy. It also opposes men’s participation in women’s sports for reasons of safety and fairness.
Following Trump’s order, the CIF publicly stated its intention to adhere to state laws that allow athletes to join teams based on their declared gender identity, rather than biological sex.
