“The charges announced today are just part of our efforts to target all aspects of Hamas' operations,” Attorney General Merrick Garland said in a video statement. “These actions will not be our last.”
The criminal complaint was filed in the Southern District of New York and lists six members of Hamas' leadership.
The five – Ismail Haniyeh, Yahya Sinwar, Mohammed al-Masri, Marwan Issa, Khaled Meshaal and Ali Baraka – face a total of seven charges, including terrorism, conspiracy to kill Americans and conspiracy to use weapons of mass destruction.
The indictment also marks the first formal criminal action by the Justice Department to hold individual foreign nationals accountable for attacks that killed more than 1,200 civilians.
“As of the date of this indictment, at least 43 U.S. citizens are among those killed, and at least 10 U.S. citizens are being held hostage or are missing,” the prosecutors said.
