Concerns Over Biden Administration’s Pardons

A senior official from the Justice Department has raised alarms about the integrity of pardons granted under the Biden administration, particularly those issued with mechanical signatures. These last-minute pardons, which may lack legal validity, have been termed “suspect.”

As reported, former President Joe Biden issued a total of 4,245 acts of clemency during his time in office. This figure comprises a mixture of amnesty, tolerance, and remission actions.

In a conversation with the New York Times, Biden acknowledged that he did not personally evaluate each case. Rather, his team provided him with various “categories” of cases for him to approve.

“First of all, there are categories. They don’t read names for the industry,” he mentioned while reflecting on the decision-making process of his administration. There was a noticeable pause as he sought his words, “Mark is a good guy. We know how vindictive Trump is. There’s no doubt they chased Mark for no good reason,” he added.

In the same interview, Biden defended the practice of using the autopen for signing official documents, stating, “Auto pens are legal. Other presidents have used it, including Trump. But the point is, we’re dealing with a lot of people.”

However, an email from January 18th, recently released by the Justice Department, shows criticism from Deputy Attorney General Bradley Weinsheimer regarding certain pardons being overly vague. He expressed concerns that the DOJ was unable to fully investigate candidates for clemency due to significant objections from victims’ families.

Notably, some violent offenders have been among those granted clemency during Biden’s term. This includes Russell McIntosh, who had committed heinous crimes, alongside various gang leaders and individuals convicted of serious offenses. These individuals have either received reduced sentences or were freed altogether due to these pardons. Biden did not respond to Weinsheimer’s January email regarding these issues.

Mike Howell, director of a surveillance project, commented on the implications of Biden’s pardons, saying it highlighted that Biden may not be in full control within the White House. Howell speculated whether this will lead to real accountability or merely become a point of political humor, referring to the situation as the “Autopen presidency.”

The surveillance project has been looking into the extensive use of the autopen during Biden’s term, suggesting that it might reflect the president’s declining abilities. They even categorized different autopen signatures and compared them to identify alterations in Biden’s handwriting style.

The investigation has extended to examine pardons made on Biden’s final day in office, which were approved despite previously raised concerns. Some individuals included in this list are notable figures like Dr. Anthony Forsey and members of the January 6th Committee, as well as several members of Biden’s family.

Additionally, there is evidence suggesting Biden was engaged in leisure activities, such as golfing in the Virgin Islands, coinciding with the day pardons were granted to certain criminals. The surveillance project is now calling for a reevaluation of these pardons, framing some as unlawful.

In response to the unfolding situation, former President Trump has argued that pardons signed via autopen should be deemed invalid since March 2025, despite no official actions being taken against the Biden administration thus far.

House Oversight Committee Chairman James Comer expressed skepticism regarding the large volume of pardons and indicated that continued investigations will aim to prevent similar situations in the future.

In the midst of these discussions, the question remains whether the use of automated signatures during such critical decisions holds up against the expectations of presidential responsibilities and accountability.
