In a statement, Mangion's New York defense attorney, Karen Friedman Agnifilo, said the move to seek the death penalty was “wild bar.”

“Their decision to enforce Luigi is political and opposes local federal prosecutors, laws and recommendations of historical precedents. The federal government commits a murder sponsored by Luigi's pre-buried state, while insisting on protection from murder.

“We are ready to fight these federal accusations, the New York State accusations, the Pennsylvania State accusations, and anything they want to build up on Luigi.”

Agnifilo argued that Mangion was “engaged in a high stakes game of tug-of-war between state and federal prosecutors, except that the trophy is the life of a young man.”
