The Illinois State Board of Elections announced Tuesday that it will keep former President Donald Trump on the state’s primary ballot.
The confirmation comes a week before the U.S. Supreme Court is set to hear arguments on whether Republicans’ alleged involvement in the Jan. 6, 2021, attack on the U.S. Capitol disqualifies him from being president.

However, the hearing officer recommended that the board leave the final decision to the court.
The board, which is made up of four Democrats and four Republicans, decided it did not have the authority to decide whether Trump violated the Constitution and left Trump on the ballot, the Associated Press reported. He said he agreed with his lawyer’s recommendation to leave the house.
The issue is likely to be decided in a higher court, with the U.S. Supreme Court scheduled to hear arguments next week in Trump’s appeal of a Colorado ruling that declared him ineligible to serve as president.
