Donald Trump to Sue Judge Juan Merchan in Gag Order Challenge

Former President Donald Trump will reportedly challenge New York State Supreme Court Justice Juan Machan to the Court of Appeals, challenging the sweeping gag order.

President Trump believes Marchand should step aside, citing a conflict of interest related to his daughter’s position at a Democratic consulting firm that helped President Biden’s 2020 campaign.

The lawsuit was not immediately made public, but court records showed on Monday that Trump had filed an 11th-hour lawsuit against Judge Juan M. Marchan seeking a delay in the case. . Online court documents in Trump’s lawsuit show that relevant documents were sealed.

And the appellate court may act quickly to dismiss it. An appeals court judge is likely to issue a preliminary ruling on Monday, and a five-judge panel will be set up in the coming days to consider Mr. Trump’s request.

Mr. Trump’s lawyers have tried several times to delay the trial, but this is the first time they have tried to do so in an appeals court. The former president, who is certain to become the Republican presidential nominee again, aims to get all four criminal cases through by election day. If he wins, the lawsuit is likely to end.

As Breitbart News’ Nick Gilbertson reported, the gag order means that President Trump will not be allowed to participate as witnesses in the trial, or to allow attorneys other than Manhattan District Attorney Alvin Bragg (D), “court staff and Prevents him from commenting publicly about the district attorney’s staff or any attorney other than “the District Attorney’s staff.” …Family members of defense attorneys or staff members, if these statements were made with the intention of…substantially interfering with the work of defense attorneys or staff members regarding the case. President Trump said on Saturday that it was a “tremendous honor” for him to “clink” and become a “modern-day Nelson Mandela” for telling the truth about Mr. Marchan.
