A six-year-old girl died from injuries sustained in a single-vehicle accident in Alabama caused by an illegal immigrant driving with an alcohol content three times the legal limit.

The Alabama Law Enforcement Agency (ALEA) noted the child was not in a car seat or fastened in a standard adult restraint, WALA-TV report.

According to investigators, Gomez began driving at 3 a.m. with his girlfriend, child and dog in the car. However, after an argument, his girlfriend and dog got out of the car. Gomez then continued driving with his child in the car until he reached a section of Baldwin County Road 28, where he was allegedly driving 68 mph in a 45 mph speed limit zone.
Police said the man flipped the car over and the unrestrained girl was thrown from the vehicle, but as the car rolled it fell on top of her.
“He lost control of the vehicle, hit a fence and overturned. The child was thrown from the vehicle before it overturned and the vehicle fell on top of the child.” Said Assistant District Attorney Theresa Heinz, a chef.
“He admitted to being at a party where alcohol was consumed. He admitted to being so ‘intoxicated’ that he blacked out and did not remember the actual events of the actual accident,” Heinz added.
The girl was taken to hospital but later died from her injuries.
Police said Gomez’s blood alcohol level was 0.22, three times the legal limit in Alabama.
On Wednesday, Baldwin County District Judge Bill Scully set bail at $200,000 for Gomez, who was charged with driving while intoxicated and first-degree assault. Because the child died, the charge was upgraded to manslaughter.
If a suspect is released on bail, he or she will be required to wear an ankle monitor and an alcohol monitor.
