Election Will Decide the Outcome

Following former President Donald Trump’s guilty verdict in Manhattan on Thursday, legal experts have weighed in, with some saying the conviction will likely be overturned and others saying the upcoming November election will determine the final decision.

“I, like many others, obviously disagree with this ruling and believe that it will eventually be overturned in the state or federal system,” said Jonathan Turley, a legal analyst at X.

“But this was the worst possible outcome for a Manhattan trial. This outcome is disappointing more for the New York justice system than it is for the former president. We had hoped that the jury would restore integrity to a system that has been exploited for political purposes,” he added.

During an appearance on Fox News after the verdict, Turley also said the ruling in the case was “legally unfounded.”

“What we didn’t know when the guilty verdict was read was what he was found guilty of,” he said. “If you remember, the judge allowed the jury to find him guilty of any one of three secondary offenses. We weren’t told whether the jury found guilty of any one of those offenses or all three. I don’t know if we’ll ever find out. And that’s one of many issues that I think is causing irreparable problems in this case.”

Turley said the convictions will likely be overturned in state or federal appeals.

Former U.S. Attorney Brett Tolman appeared on Fox Business and offered a similar view.

“There are ample grounds for an appeal to overturn this case. “I’m not talking about a gray area, I’m talking about a black and white violation by a judge,” Tolman said.

Alan Dershowitz, the longtime Democratic lawyer who defended Trump in his first impeachment trial in the U.S. Senate, said Trump will have a long road to appeal and stressed that the outcome will likely be decided by the November election before a conviction can be overturned. A verdict in Trump’s case is scheduled for July 11, but the former president is expected to appeal well before that date, likely delaying a ruling until after the November election.

As The Hill He noted that a ruling in the case would likely be delayed until the November election because the former president is likely to appeal.

The Trump campaign must file a notice of appeal with the court within 30 days and file a full appeal within six months, setting off a new and drawn-out legal battle that is likely to continue beyond the November election.

It’s also possible that an appeals court could put Trump’s ruling on hold, putting the matter on hold while he challenges it.

Another legal expert said: The Washington Times Any appeal by the former president’s legal team will likely focus on Judge Marchan’s instruction to the jury that a defendant “does not have to be unanimously found guilty of a felony” in order to reinstate a misdemeanor record-keeping charge that has become time-barred.

“The judge instructed the jury that they only had to find that Trump committed bookkeeping violations to conceal campaign finance violations, tax violations or falsifying business records. They did not have to agree on an underlying crime to convict the former president,” the judge wrote. Times.

“The issue of whether a second crime exists is really a legal issue that should be heard on appeal,” said John Yoo, a professor at the University of California, Berkeley.

“The fact that the prosecution was not forced to specifically identify the underlying crimes that make this business records case a felony, and that jurors were allowed to choose their own underlying crimes rather than needing to be unanimous, is sure to be viewed with skepticism by an appellate court,” said Thomas Hogan, a professor at the South Texas College of Law in Houston.
