Authorities have announced that Brady Kiser, the husband of social media influencer Emilie Kiser, will not face any charges in relation to the tragic drowning of their 3-year-old son, Trigg Kiser.

The Maricopa County Attorney’s Office stated that an extensive investigation concluded there wasn’t enough evidence to proceed with charges against Brady.

Maricopa County Attorney Rachel Mitchell explained that the decision was made because there was “no reasonable likelihood of conviction.” Surveillance footage from outside their home helped clarify the circumstances surrounding the drowning and the sequence of events.

To secure a conviction, prosecutors must demonstrate that the accused failed to recognize a substantial and unjustifiable risk, with that oversight being a gross deviation from what a reasonable person would consider acceptable care.

Officials specified that every case is assessed based on the possibility of a conviction. In this instance, they concluded that the evidence didn’t meet that standard. Furthermore, due to a court order, they indicated that they couldn’t provide additional details.

Trigg, who was found unresponsive in the family’s swimming pool on May 18, tragically passed away shortly after. Brady was present during the incident and mentioned to investigators last month that he had been “distracted” by their newborn at the time of Trigg’s drowning.

In the wake of these events, the Chandler Police Department had previously suggested that Brady should face a Class 4 felony charge for child abuse; however, the county chose not to act on that recommendation.
