EEOC Investigates Nike for Alleged Discrimination
The Equal Employment Opportunity Commission (EEOC) has launched an investigation into Nike concerning claims of discrimination against white employees and job applicants, as reported by various sources.
According to a complaint filed by the EEOC on Wednesday, the agency is looking for “information directly related to allegations” that Nike has “subjected white employees, applicants, and training program participants to unequal treatment based on race” across different employment decisions. The New York Times noted that the complaint aims to “compel Nike to comply with a subpoena issued last September.”
The EEOC specified that it is investigating claims suggesting that Nike treated white employees, applicants, and participants in training programs differently, particularly in areas like layoffs, internships, mentoring, and leadership development initiatives.
This inquiry into alleged discrimination comes at a challenging time for Nike. The company, recognized as the largest sportswear brand globally, is attempting to rebound from a significant sales slump attributed to strategic misjudgments over the past few years. Management has been focusing on clearing old inventory, speeding up product development, and solidifying the brand’s commitment to athletics.
In 2021, Nike introduced a five-year strategy aimed at enhancing workforce diversity. The company linked a portion of executive pay to achieving diversity goals, such as increasing female representation in leadership and aiming for 35% racial minorities within its U.S. workforce.
CNN has reported that the EEOC is requesting information from Nike dating back to 2018 regarding “race-based workforce representation quotas,” implying that decisions about firing and promotions may have been influenced by race. Furthermore, the agency is looking into 16 mentoring and career development programs described as “racially restricted.”
Authorities have indicated they are pursuing enforcement actions because Nike reportedly did not voluntarily submit all the information requested in the subpoena.
